Terms and Conditions

Vehicles must comply with these conditions. By entering and proceeding to park a vehicle in this car park you accept and agreed to be bound by these contractual conditions. If you do not accept any of these terms, you must immediately remove your vehicle from this car park.  

1.You must

  (a)Pay the require fees and other costs which may be incurred in relation to the vehicle upon demand. A further   parking fee is payable each time the vehicle enters this car park. If you lose or fail to present a ticket required to be   presented upon leaving the car park, you will be charged the maximum daily fee of the lost ticket fee (whichever is   greater). Tickets are not transferable and are valid for only one stay.

  (b)Comply with all parking signs and only park your vehicle within the line markings that constitute marked parking   bays or as directed by us.

  (c)Not park your vehicle:
      (i) In a way that is contrary to any instructions we may give you;
     (ii) In any area that is designated as a no-parking, no-standing, reserved or parking zone; or
     (iii) In any place that obstructs   any internal roadways or exits

 2. If you fail to comply with clause 1 of these Contractual Terms and Conditions or if your ticket or pass expires you agree to pay us the additional costs associated.

3. We may revoke you licence to use our car parks at any time without notice.

4. We may retain your vehicle until a valid pass or authority is produced and all outstanding charges related to the vehicle are paid. Charges will continue to accrue for so long as we retain your vehicle. If amounts due to us are not paid within 30 days you agree that we may remove and sell your vehicle to recover the amount due to us together with all costs of such removal and sale and you agree to us taking all necessary steps to do this.

5. We may enter, move, drive any perform works to any vehicle left within this car park even if it is locked if it is reasonably necessary for the sole operation of this car park.

6. We may deliver the vehicle or its keys to any person producing a pass or presenting other authority to retrieve the vehicle which we may in our sole discretion believe is satisfactory and we shall not be liable for any loss or damage you may suffer as a consequence.

7. We will exercise all required care in the operation of this car park as is required by the Australian Consumer Law and other applicable State legislation. Apart from this statutory liability, we will not be liable for any damage suffered by you as a result of your use of this car park whether in tort, contract or otherwise.

8. You agree to indemnify us for any claim made against us arising from or related to your use of this car park, any breach by you of you Contractual Terms and Conditions or for anything done by us pursuant to these Contractual Terms and Conditions.

9. You are liable and shall indemnify us for any damage caused by you or the vehicle to the Car Park including, but not limited to, any damage caused by oil or other substances which leaks from the vehicle.

10. These Contractual Terms and Conditions may not be varied or waived without our   prior written approval from the Managing Director of SkyPark Melbourne Pty Ltd.  

11. If any part of these conditions is void, voidable, unenforceable, or illegal, the offending part shall be severed and the remainder will have full force and effect.

12. In these conditions:
  (a)“we”, “us” and “our” means SkyPark Melbourne Pty Ltd CAN 34 647 434 571 its directors, employees, servants,   agents and assignees;

   (b)“your vehicle” includes a vehicle driven or intended to be driven by you into this car park.  

Traveling with Children Policy

TRAVELLING WITH CHILDREN POLICY
DO YOU HAVE A CHILD UNDER 7 YEARS OF AGE?

SkyPark Airport Parking’s most important priority is to ensure that you and your children arrive at your destination safely. 
If you are travelling with children under the age of 7, they are required by law to be seated in suitable child restraint when travelling in SkyPark Airport Parking shuttle buses.

We have a limited number of restraints and require you to be at SkyPark 1 hour before your required check in time.

We have three (3) forward-facing/rear-facing convertible child restraints and three (3) booster seats fitted by trained representatives. 

These are available in three (3) of our designated vehicles.

 OUR POLICY: 

1.    All children under 7 will not be permitted to travel in a SkyPark Airport Parking shuttle bus unless they are accompanied by their parent, guardian or another adult who is responsible for them. 

2.    SkyPark Airport Parking will not permit any child to be seated in the front seat of any shuttle bus.  

3.    All Children under seven (7) years of age are legally required to travel in a suitable child restraint.  

4.    Children 6 months or under must be seated in one of our rear-facing child restraints. Parents will not be permitted to use or install their own child restraints in any SkyPark Airport Parking shuttle bus. 

5.    Children 6 months to under 4 years of age must be seated in one of our forward-facing child restraints. Parents will not be permitted to use or install their own child restraints in any SkyPark AirportParking shuttle bus.  

6.    Children over 4 years of age and under 7years of age, must be seated in a booster seat that is used in conjunction with an adult lap/sash seatbelt. The seatbelt must be correctly adjusted to protect the child in the instance of a crash. 

7.    It is the responsibility of the adult travelling with the child to ensure that the restraint or booster seat is suitable for their child and that all seat belts and harnesses are properly fastened and tightened so as to protect the child in the event of an accident.   

8.    Although we will endeavour to have a vehicle fitted with an appropriate child restraint or booster seat available, SkyParkAirport Parking does not guarantee the availability of a booster seat or appropriate child restraint in the shuttle buses. We will not be responsible for any delays, inconvenience or losses which may arise if we cannot supply a child restraint or booster seat.  

9.    SkyPark Airport Parking accepts no responsibility for passengers that provide false information regarding the age of their children.

Nothing in this policy shall betaken to affect the standard or duty of care that is owed by SkyPark AirportParking and its directors, employees, servants, agents and assignees to passengers in our shuttle buses.

Privacy Policy

This Privacy Policy applies to all personal information collected by SkyPark Melbourne PTY LTD viathe website located at skyparkm.com.au.

2. What information do we collect?

(a) The kind of personal information that we collect from you will depend on how you use the website. The personal information which we collect and hold about you may include: email, phone number, licence plate, first and last name, postcode.

3. How we collect your personal information

(a) We may collect personal information from you whenever you input such information into the website.We also collect cookies from your computer which enable us to tell when you use the website and also to help customise your website experience. As a general rule, however, it is not possible to identify you personally from our use of cookies.

4. Purpose of collection

(a) The purpose for which we collect personal information is to provide you with the best service experience possible on the website.

(b) We customarily disclose personal information only to our service providers who assist us in operating the website.
Your personal information may also be exposed from time to time to maintenance and support personnel acting in the normal course of their duties.

(c) By using our website, you consent to the receipt of direct marketing material. We will only use your personal information for this purpose if we have collected such information direct from you, and if it is material of a type which you would reasonably expect to receive from use. We do not use sensitive personal information in direct marketing activity. 6. Complaint Procedure

(a) If you have a complaint concerning the manner in which we maintain the privacy of your personal information, please contact us as set out below. All complaints will be considered by Joshua DiPietro and we may seek further information from you to clarify your concerns. If we agree that your complaint is well founded, we will, in consultation with you, take appropriate steps to rectify the problem. If you remain dissatisfied with the outcome, you may refer the matter to the Office oft he Australian Information Commissioner.

7. Overseas transport

(a) Your personal information may be transferred overseas or stored overseas for a variety of reasons. It is not possible to identify each and every country to which your personal information may be sent. If your personal information is sent to a recipient in a country with data protection laws which are at least substantially similar to the Australian Privacy Principles, and where there are mechanisms available to you to enforce protection of your personal information under that overseas law, we will not be liable for a breach of the Australian Privacy Principles if your personal information is mishandled in that jurisdiction. If your personal information is transferred to a jurisdiction which does not have data protection laws as comprehensive as Australia's, we will take reasonable steps to secure a contractual commitment from the recipient to handle your information in accordance with the Australian Privacy Principles.
